1. Acceptance of Terms

By accessing or using Campaign Finance Manager ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Campaign Finance Manager provides software tools for political campaigns to:

  • Track campaign contributions and expenditures
  • Manage donor and volunteer information
  • Connect bank accounts for automated transaction sync
  • Generate FEC and state-level compliance reports
  • Process online donations via Stripe
  • Communicate with donors via phone and SMS

3. User Accounts

3.1 Account Creation

You must create an account to use the Service. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information
  • Keep your password secure and confidential
  • Notify us immediately of unauthorized access

3.2 Account Responsibility

You are responsible for all activity under your account. We are not liable for losses from unauthorized use.

4. Acceptable Use

You agree NOT to:

  • Violate any federal, state, or local campaign finance laws
  • Submit false or fraudulent information
  • Use the Service for illegal activities
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Service
  • Reverse engineer or copy any part of the Service
  • Use automated tools to access the Service without permission
  • Harass, abuse, or harm other users

5. Compliance with Campaign Finance Laws

Important: You are solely responsible for compliance with all applicable campaign finance laws and regulations, including but not limited to:

  • Federal Election Campaign Act (FECA)
  • FEC regulations
  • State campaign finance laws
  • Contribution limits and reporting requirements
  • Prohibited source rules

While we provide tools to assist with compliance, we do not provide legal advice. Consult with a campaign finance attorney or compliance expert.

6. Bank Account Connection

When connecting your bank account via Plaid:

  • You authorize us to access your bank transaction data
  • You represent that you have authority to connect the account
  • You can revoke access at any time
  • We use bank data only for the purposes described in our Privacy Policy
  • You remain responsible for reviewing and verifying all transactions

7. Payment Processing

Donation payments are processed through Stripe. You agree to Stripe's terms of service. We charge a platform fee as disclosed during account setup.

8. Data Accuracy and Review

You are responsible for:

  • Reviewing all automatically synced transactions
  • Verifying donor information accuracy
  • Approving transaction categorizations
  • Reviewing compliance reports before filing
  • Correcting any errors or inaccuracies

We provide automated tools as a convenience, but final accuracy is your responsibility.

9. Intellectual Property

The Service, including software, designs, text, graphics, and logos, is owned by us and protected by copyright, trademark, and other intellectual property laws.

You retain ownership of your campaign data. We have a license to use your data solely to provide the Service.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OR COMPLETENESS

We do not guarantee uninterrupted, error-free, or secure service.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

  • Indirect, incidental, special, or consequential damages
  • Loss of profits, revenue, data, or goodwill
  • Campaign finance penalties or fines
  • Errors in data, reports, or categorizations
  • Third-party service failures (Plaid, Stripe, etc.)

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including attorney fees) arising from your use of the Service, violation of these Terms, or violation of campaign finance laws.

13. Termination

We may suspend or terminate your account at any time for:

  • Violation of these Terms
  • Illegal activity
  • Non-payment
  • Fraudulent behavior

You may terminate your account at any time. Upon termination, you remain responsible for outstanding fees and must export your data within 30 days.

14. Modifications to Terms

We may update these Terms periodically. Continued use of the Service after changes constitutes acceptance of the updated Terms. Material changes will be communicated via email.

15. Governing Law

These Terms are governed by the laws of the State of Alabama, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Alabama, Autauga County.
